Your privacy is important to us. This Privacy Notice describes how Mattress Firm, Inc. (“Mattress Firm”, “we”, “our” and “us”), the operator of the Sleep.com mobile app, collects data from you through our interactions with you, via our various products and services, and also describes how we use and store that data with your explicit consent. This Privacy Notice identifies the choices you can make about the data we collect and store, and how you may revoke consent to those processes.
Mattress Firm offers a range of products and services focused on helping you understand and optimize your overall sleep through use of collected sleep data. The Application helps you track your sleep data including sleep duration, sleep onset, sleep staging and other collected information to provide a SleepScore® and other key metrics that allow you to take actionable steps to better sleep (all collectively, “Services”). Your data is necessary for us to provide the Services.
We collect and use your data to allow us, as part of the Services provided to you, to properly measure and create a personalized path to achieve better sleep. The use of your collected personal sleep data is necessary for Mattress Firm to deliver Services that involve analyzing and evaluating sleep conditions and solutions. We do not and will not sell your data to any third-party in exchange for money. From time to time, however, we may authorize our service providers and third parties with whom we share your information to use such information to improve their products and service offerings, including the services that they offer to Mattress Firm.
Please carefully read this Privacy Notice and also our Terms of Service to understand how Mattress Firm may collect, use and share your personal information. The terms “we”, “us” or “Mattress Firm” are each intended as reference to Mattress Firm, Inc.
Why We Use Your Personal Information
We use your personal information if you consent to this use by any of downloading, installing and using the Application.
How We Collect and Use Personal Information
Mattress Firm collects your personal information to operate effectively and provide you with the appropriate sleep advice and recommendations to achieve better sleep. You have the option to decline when asked to provide personal information. But if you elect not to provide data that is necessary to a product or service feature, you may not be able to use all Services or features of the Services given the provided information is necessary for us to perform certain critical Services tasks and to support Services features.
We use the data that we obtain through our interactions with you to personalize sleep advice and insights along with recommendations of relevant sleep services and products that may help your sleep condition based on analysis of your collected sleep data.
We use collected data to continually improve our product and services including adding new features and enhancing accuracy of the platform. For example, we use sleep data and demographics to improve the relevancy of the sleep advice, insights and recommendations we provide by training sleep models and algorithms.
We may use your data to customize your experience with us. We may collect data about your activities on and interactions with various devices and link that information. Through such cross-device linking, we can provide you with a consistent experience across the devices you use. We may also combine data we get from you with information about you we have received from third parties or publicly available sources to assess trends and interests.
We may use your personal information across all of our brands in order to serve you with advertising, promotions, recommendations, content and offers that we believe may be of interest to you, based on the information we collect through the Application. In certain circumstances, we may send you communications about special promotions or offers via regular mail, email, or other electronic channels, including ads served on social media platforms. We may also use your data to conduct marketing research in order to optimize our marketing strategies.
We will use your personal information to authenticate your identity and provide you with secure access to the Services. We will also use personal information for security and fraud prevention purposes, to protect our company, our customers or our assets (including the Application).
The data we collect varies based on your interactions with Mattress Firm, and your selections regarding various Services product settings and the specific product and features you may utilize. The following are a list of the categories of data we collect:
Personal Contact Data, Credentials and other Data Collected:
Data We Collect: Basic account data that includes your first and last name, date of birth, phone number, email, IP address, postal address, username and password. This may also include preferred language. All of our databases are encrypted.
Why: We collect this information to authenticate, secure and provide you with access to our Services and to verify that you are age eligible to use the Services. We also use this information to communicate with you as to your account, sleep progress, news and other information that may be pertinent to you which you may opt out of. We also use this data to provide you with product and service recommendations and to serve ads to you.
Sleep Data:
Data We Collect: Through your use of the Application to quantify your sleep, we collect measurements of your respiration, movement, noise disturbances, and other sleep measurement data. During onboarding we request personal information including height, weight, age, and gender.
Why: Use of your collected sleep data is used to provide your daily SleepScore®, and powering the engines based on your measured personal sleep condition, provides necessary insights, advice, and education to help you achieve greater understanding of your sleep condition. Your personal information is needed for that guidance. Personalized solution recommendations may include general product or service categories or specific products or services, some of whom we may have a relationship with. Your height, weight, age and gender are critical to calculating your recommended sleep solutions. And access to your sleep data is required for the Application to work.
Sleep Environment Data:
Data We Collect: Through questionnaires we may ask you questions relating to your specific sleep environment and products used to help you sleep. This information may include information regarding your mattress, curtains, sleep aids, and other related information pertaining to your sleep.
For users of iOS Health app, to improve our ability to provide personalized sleep analysis and recommendations, Mattress Firm, via the Application, requests permission to read and write health data from the Health app. Thereby allowing the importing of SERVICE sleep parameters into the Heath app. Mattress Firm does not use HealthKit data for advertising purposes and will not sell Healthkit data. Your Apple® device will only allow Mattress Firm, via the Application, to read and write such data if you grant permission via your device’s settings.
For users of Google Health Connect, to improve our ability to provide personalised sleep analysis and recommendations, Mattress Firm, via the Application, requests permission to read health data from Google Health Connect. Thereby allowing the importing of SERVICE sleep parameters into the Health app. Mattress Firm does not use Health Connect data for advertising purposes and will not sell Health Connect data. Your Health Connect device will only allow Mattress Firm, via the Application, to read such data if you grant permission via your device’s settings. The use of information received from Health Connect will adhere to the Health Connect Permissions Policy, including the Limited Use requirements .
Why: We collect information regarding your sleep environment to supplement your sleep data to improve our ability to provide personalized sleep analysis and recommendations.
Location Data:
Data We Collect: For users accessing our sleep data services through the Application, we request to collect data about your precise geolocation. This information may include using identifying nearby cell towers and Wi-Fi hotspots. Our sleep analysis products necessarily require your precise geolocation data.
Why: Location-based data can include local weather, allergen, and related data available in the public domain to supplement our sleep data collected to help provide improved sleep recommendations. Location information helps render our sleep recommendations more data-driven and more accurate. If we lack location data, and the other data that location data confirms (like weather and allergen data), we may be unable to provide accurate sleep recommendations and guidance.
Contacts and Relationships:
Data We Collect: You may choose to add your contacts’ information and information regarding relationships with others (who may also be consumers utilizing our platform).
Why: Allowing participation in social or friends and family sharing capabilities hosted by Mattress Firm or its partners can greatly enhance your experience with our platform and adds to the information we can utilize to guide our sleep recommendations.
Usage Data:
Data We Collect: Data about your device and how you and your device interacts with Mattress Firm and our products and services can be necessary to provide you a more personalized experience.
Technical Information: We collect information from your mobile device when you access or use the Application and Services, such as browsing history and search history within our sites. This information includes device and network information, cookies, log files and analytics information which we use to increase our ability to improve our services.
Customer Service / Troubleshooting: When you engage with customer service, we collect data about you, your device, software, app, and other details related to the issue. When you contact us for customer support, any phone conversations, email correspondences or chat sessions with our representatives may be monitored and recorded. These may also include error and performance reports used to help customer support in identifying potential issues.
Why: We use data to provide improve customer service and efficient troubleshooting of potential user issues. We use data to develop aggregated analysis and business intelligence to enable us to operate, improve, make informed decisions, secure, and report on performance of the business.
Sleep Research Content:
Data We Collect: We collect content that you may share with Mattress Firm which may include posts, feedback, reviews, files, questions, information, or comments through social media, customer service or the community.
Why: We may use data we collect at an aggregated level (no personal identifiers included) to gain new insights into sleep which may be used by the company or its partners to improve overall state of sleep science. Such insights may be published from time to time. All data will have any personal identifiers removed. This information is a valuable contributor toward accurate sleep guidance as scientific insights gained from this information can be used to continually improve Mattress Firm’s products and services.
SleepScore®
Data We Collect: We collect your daily SleepScore® that is generated by the Application through your use of the Services.
Why: We use your daily SleepScore® to further provide you with the Services. We may also disclose your SleepScore to our different brands, including Mattress Firm and Sleep Experts, to make product and service recommendations to you and for marketing research purposes.
Cookies and Similar Technologies
We may use tracking tools like clickstream data, cookies and pixel tags. You may disable some of these tracking tools by managing your cookie preferences as detailed by the Application; however, if you choose to download or use our Application or any of the Services, you expressly consent to the use of those tracking tools that are necessary for the proper functioning of the Application and the Services.
Clickstream Data
Clickstream data is a record of your activity on the internet. This data is recorded whenever you click anywhere in an application and is used for the purposes of collecting, analyzing and reporting data about how you use our products and services. This method of data collection is used to capture non-personal information.
Cookies
A cookie is a small text file that may be stored on your device when you access the Application or any of the Services. A "session cookie" expires immediately when you end your session (i.e., close the Application). A "persistent cookie" stores information on the device so when you end your session and return to the Application at a later date, the cookie information is still available. When you use the Application, we may use both a session and a persistent cookie. These cookies may contain information (such as a unique user ID) that is used to track your usage of the Application and in some cases, your e-mail address. Your e-mail address is only saved in this cookie if you register with us.
If you register with us, this cookie allows us to recognize you when you return to the Application and provides you with access to your account information. If you save your information with or order from us, we may also use cookies to monitor and maintain information about your use of the Application.
When you choose to go to a partner website to learn more about or purchase a Recommended product or service we store the data in a cookie and other similar technologies to help facilitate your experience by embedding profile information and associated coupon code where applicable.
If you have not created an account with us, we may still use cookies to monitor and maintain information about your use of the Application. We may use cookies to collect information described above in order to 1) provide you with customized content and advertising; 2) monitor usage of our websites; and 3) conduct research to improve our content and services. You are free to decline cookies, but by doing so, you may not be able to use certain features on our Application or take full advantage of all our offerings. Pixel Tags
A pixel tag (also known as a web beacon) is a small string of code that represents a clear graphic image and is used in conjunction with a cookie. A pixel tag allows us to capture certain additional types of information about a user’s actions through the Application, such as a user’s cookie number, the time, date, duration and number of page views, a description of the page where the tag is placed and details about any items that were purchased. Pixel tags help us analyze our customers' online behavior and measure the effectiveness of our marketing and our advertising. We work with service providers that help us track, collect and analyze this information.
E-mail Marketing
If you are opted in to receive marketing e-mails from us and wish to unsubscribe, you can do so by clicking on the Unsubscribe hyperlink at the bottom of the marketing e-mail you receive. We will note in our database that you have elected to opt out of future e-mails from our company. Your record will still remain in our database but you will not receive any future mailings unless we manually opt you back in.
You may also choose to opt out of e-mails by sending an e-mail to us at customerservice@mattressfirm.com. If you choose to opt out with this method, please be sure to include the e-mail address that you would like us to unsubscribe.
Reasons We Disclose Personal Information
We disclose personal information to our parent, subsidiaries, and affiliates for business operations.
We disclose personal information to vendors, partners or agents working on our behalf for the purposes described in this statement to provide our Service. An example being that we use a service provider, SleepScore Labs, LLC, which developed the Application on our behalf, to collect and process, on our behalf, the data obtained from you through the Application.
We may disclose your information to third parties who provide services to Mattress Firm such as supporting,improving and promoting the Services. Third party service providers will only have access to the information necessary to perform these limited functions on our behalf and to comply with applicable law and are required to protect and secure your information. We may also engage third parties to collect information about your use of the Services over time on our behalf so that we may promote Mattress Firm and our products and servicesor display information that may be relevant to your interests on the Services or other websites or services. Mattress Firm is not responsible for the terms or policies of third parties.
Subject to your privacy settings, your information and content may be publicly accessible should you authorize that, which is your choice.
If Mattress Firm becomes involved in a business combination, securities offering, bankruptcy, reorganization, dissolution or other similar transaction, we may share or transfer your information in connection with such a transaction.
We may preserve and disclose your information to third parties, including law enforcement, public or governmental agencies, or private litigants, within or outside your country of residence, if we determine that such disclosure is reasonably necessary to comply with the law, including response to court orders, warrants, subpoenas, or other legal or regulatory process. We may also retain, preserve or disclose your information if we determine that disclosure is reasonably necessary or appropriate to prevent any person from death or serious bodily injury, to address issues of national security or other issues of public importance, to prevent or detect violations of our Terms of Service or fraud or abuse of Mattress Firm or its affiliates or other users of the Application, or to protect our operations or our property or other legal rights, including by disclosure to our legal counsel and other consultants and third parties in connection with actual or potential litigation.
Please note through affiliate product or service recommendations, you may elect to select links to partner sites whose privacy policies differ from Mattress Firm. Should you provide personal information to any of those products and services or partners, your data shall be governed by their respective privacy policies. We are not responsible for third-party practices or policy terms.
We may also have to disclose personal information necessary to:
- Protect customers’ security, or to prevent the loss of life or severe injury;
- Operate and maintain the security of our products which include internal and third party computer systems and networks vital to the operation of our products; and
- Protect the rights or property of Mattress Firm, including enforcing the terms governing use of the services.

Access and Control of Your Personal Information
You can view and manage your data via the Application. For example, you can view and update your profile data, user settings, and view historical sleep data.
You may delete a specific night’s tracking session, and the session would be deleted from the Application however, the basic measurement data and other data captured by the Application remain in the database, accessible by Mattress Firm.
Uninstalling the Application
If you wish for us to stop collecting personal information from you by means of the Application, you must uninstall the Application.
Deleting Information and Accounts
Uninstalling the Application does not close your account. You may request that your account and the personal information we have collected about you be deleted by submitting a request online by mail to: by mail to: Mattress Firm, Inc., 3250 Briarpark Drive, Suite 400Houston, Texas 77042, Attn: Legal Department – Consumer Privacy. Once deleted, your data, including your account, activities and place on leaderboards cannot be reinstated.
Note that content you have shared with others or that others have copied may also remain visible after you have deleted your account or deleted the information from your own profile. Your public profile may be displayed in search engine results until the search engine refreshes its cache.

Security of Personal Information
Mattress Firm is committed to protecting the security of your collected personal information. We use a variety of security technologies and procedures to help protect your personal information from unauthorized access, use or disclosure. For example, we store the personal information you provide encrypted and on computer systems that have limited access and are in controlled facilities.
While Mattress Firm continues to work hard to protect your personal information, no data transmission over the Internet can be guaranteed to be absolutely secure, and Mattress Firm cannot ensure or warrant the security of any information you transmit to Mattress Firm. Transmitting personal information is done at your own risk.
Collection of Data from Non-US Residents and Children
We do not promote or market the Application or any of the Services outside of the United States of America and do not intend to interact with, or secure any user data from, persons who are not residents of the United States of America. If you are not a resident of the United State of America do not seek to utilize the Application or the Service. We will exclude, for purposes of our use (other than to delete and suppress), any information obtained from persons who are not residents of the United States. We do not intend to market to or interact with, or secure any User Data from, children 16 years old or younger.
You must be over the age of 18 to create an account and use our Service.
If you are a minor and wish to utilize our product or the Service, your parents or legal guardians (hereafter your “Parents”) must engage in purchasing the product or Service and additionally if you are under 18 years old give us their written consent by contacting our customer service department. Our teams will answer any questions that you or your Parents may have concerning the use of our products and services and the rules relating to the collection of personal information.
Our Service is not by design reasonably likely to attract users who reside outside of the United States or children 1) years old or younger, to purchase or otherwise use our Service.
Sleep Study or Beta Releases
From time to time, Mattress Firm may offer opportunities to participate in sleep studies or access to beta products and features. As a result, these may change the data collected and the user experience that employ different privacy and security measures from those typically present in our products. If you participate in such a study or beta release you may need to enter into a different agreement for access.
Where We Store and Process Personal Information
Personal data collected on behalf of Mattress Firm through the Application is stored and processed in the United States and accessed by authorized users for support in regions where Mattress Firm or its affiliates or service providers maintain facilities.
We take steps to ensure that the data we collect under this Privacy Notice is processed according to the provisions of this statement and the requirements of applicable law.
We keep your personal information as long as we reasonably anticipate needing it to comply with applicable law, to enforce our rights and to support our ongoing business relationship with you, in accordance with our policies.
Changes to the Privacy Notice
This Privacy Notice is subject to change from time to time when necessary based on customer feedback and changes to our products and services.
Your continued use of any aspect of the Service after Mattress Firm modification of this Privacy Notice constitutes your acceptance of the modified Privacy Notice. If any term or provision of this Privacy Notice is be found to be invalid, illegal or otherwise unenforceable, such finding will not affect the other terms or provisions of this Privacy Notice, or the whole of this Privacy Notice, but such term or provision will be deemed modified to the extent necessary to render such term or provision enforceable, and the rights and obligations of you and Mattress Firm will be construed and enforced accordingly, preserving to the fullest permissible extent the intent and agreements set forth in this Privacy Notice.
If you object to any of the changes to this Privacy Notice, you should stop using the Services and delete your account immediately. When we post modifications to this Privacy Notice, we will revise the “Last Updated” date at the top of this Notice. If the changes are material, we will endeavor to notify you in advance of such changes taking place to the extent required by law by email.

• Audio, electric, visual, or similar information, such as voice recordings if you use our customer support, video recordings of our stores, and transcripts of online chat sessions. We may disclose this information to our affiliates, service providers, government authorities, and law enforcement and collection agencies.
• Inferences, such as your SleepScore® which we use to build a profile about how well you are sleeping. We may disclose this information to our affiliates, service providers, government authorities, law enforcement, and advertisers and analytics partners.
• Geolocation data. We may disclose this information to our affiliates, service providers, government authorities, law enforcement, and advertisers and analytics partners.
Some of the above information may be Sensitive Personal Information, such as your precise geolocation, sleep health data, and gender. We use Sensitive Personal Information for legitimate business purposes, including to (i) perform services or provide goods reasonably expected by an average person; (ii) detect security incidents; (iii) resist malicious, deceptive or illegal actions; (iv) ensure the physical safety of individuals; (v) for short-term, transient use; (vi) perform or provide internal business services; or (vii) verify or maintain the quality or safety of a service or device. We do not sell or share any Sensitive Personal Information.

• From third parties. We may obtain your personal information from third-party sources, such as the iOS Health App or Google Connect, your contacts, and media companies.
How Do We Use Your Personal Information?
We may use your personal information for the following purposes:
• Provide You Products and Services: We use your personal information to provide you products and support, including to create and administer your account; provide you with customer support; and communicate with you in relation to providing you products.
• Build and Maintain Our Relationship with You: We use your personal information to improve your experience on our Services, such as by providing accurate sleep recommendations that account for local allergens and your sleep environment; understand your preferences and send you promotional messages and advertisements about products you may like; and communicate with you about products and events you may be interested in. We may also draw inferences from the personal information you provide directly to us such as information about your sleep quality.
• Improve our Services and Our Product Offerings: In order to improve your experience and provide you with products that you are interested in, we use your personal information to understand who is visiting our Services, analyze how the Services are being accessed and used, improve the functionality of our Services, including by training our sleep algorithms, and develop new product and service offerings, including conducting and contributing to sleep research and science.
• Maintain the Security of Our Services: To maintain the security and integrity of our Services, we use your personal information to detect security incidents, protect our Services against fraudulent and illegal activity and enforce our terms of use.
• Comply with Our Legal Obligations and Respond to Legal Proceedings: We use your personal information to comply with our legal, regulatory and risk management obligations. We may also use your personal information to establish, exercise or defend legal claims.

We retain your information as described in the “Where We Store and Process Personal information” section of the Privacy Notice.
We do not sell personal information for monetary consideration. However, some of our disclosures to third parties may be considered a share or sale under California law. We have sold or shared the following categories of personal information with targeted advertising service providers and partners, data brokers, and merchandise suppliers: Internet or other electronic network activity information, Identifiers, and Commercial information. We do not knowingly sell the personal information of minors under 18. Shine the Light
California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third-parties for direct marketing purposes and the names and addresses of all third-parties to which we disclosed personal information in the immediately preceding calendar year. Your California Rights
If you are a California resident, you may have the following rights with respect to the personal information we process about you:

- Right to Non-Discrimination. Should you choose to exercise any of these rights, we will not discriminate against you in any way. If you exercise certain rights, understand certain features of our website and mobile applications may be unavailable to you.
Exercising Your California Rights

You can designate an authorized agent to make a request on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with applicable law.
Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with information you have previously provided us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g. phone or email) that you have previously provided to us.
